Wrongful Search

Generally, Police officers cannot come into your house without a search warrant (there a few unusual exceptions). If a police officer asks you for permission to enter your house, you need not consent or agree to police officers coming into your house. If a police officer comes into your house without a search warrant and without your consent it may be a wrongful entry and/or search. Police officers will be liable for damages for a wrongful search of your house.

Also, generally, police officers cannot search and/or strip search you or your vehicle without a warrant unless they have “probable cause,” or, depending on the circumstances “reasonable suspicion” to believe that you have a weapon or contraband. However, if you have been legally arrested police can search you.
