Lake County in the northeastern corner of Illinois is the third most populous county in the state with an estimated population of 703,000 and second largest county in Illinois with 1,368 square miles of land and water, most of which is in Lake Michigan. The County is bordered by Cook County to the south, McHenry County to the west and Kenosha County, Wisconsin to the north. It is divided into 18 townships which include 7 cities, 46 villages and 20 unincorporated communities. Waukegan is its largest city, the county seat and the location of the Lake County Courthouse. If I Have to Go to Court, Where Will My Case be Filed?

If it becomes necessary for us to file a lawsuit to protect your rights, depending upon the nature of your case, it will be filed in The Circuit Court of the Nineteenth Judicial Circuit, Lake County, Illinois located in Waukegan or the United States District Court, Northern District of Illinois, Eastern Division located in Chicago.

If your case is filed in the United States District Court Northern District of Illinois, Eastern Division it will be assigned to one of 50 judges and magistrates and a magistrate for the duration of the case. Although cases in the District Court are governed by the Federal Rules of Civil Procedure and the Local Rules of the Northern District of Illinois, Eastern Division, each judge has his or her own set of rules to manage their courtroom, which dictate, among other things, how the case will proceed and motions will be heard. The Circuit Court of the Nineteenth Judicial Circuit of Lake County has fifteen circuit judges and twenty-four associate judges and is divided into three divisions. All cases seeking monetary damages for injuries sustained in Lake County are heard in the Civil Division. In an attempt to resolve cases early, the parties are required to participate in arbitration. Any party may reject the arbitration panel’s findings, in which event; the case will proceed to trial in the Law division, if over $50,000 in damages is sought or the Law Magistrate division, if under $50,000 is sought, of the Civil Division. The Illinois Code of Civil Procedure, the Illinois Supreme Court Rules and the Uniform Rules of Practice of the Circuit Court of Illinois, Nineteenth Judicial Circuit govern civil cases.
